The Birchbox Loyalty Program (the “Program”) sponsored by Birchbox, Inc. (“Birchbox”) is designed to help you get the most out of your membership. We reward you for doing the things you already do: shop on Birchbox.com (the “Site”), refer friends to Birchbox, and send us feedback on your samples. Best of all, you can use the points you earn to purchase more full-size products! The following terms and conditions (these “Loyalty Program Terms and Conditions”) contain important information regarding the Program. Please read the following Loyalty Program Terms and Conditions carefully. These Loyalty Program Terms and Conditions are incorporated into the Site Terms and Conditions. Acceptance of the Site Terms and Conditions includes acceptance of these Loyalty Program Terms and Conditions. These Loyalty Program Terms and Conditions are a binding agreement between you and Birchbox and will govern your participation in any and all Program offers.
Participating in the Program entitles members (“Members”) to take advantage of certain Program rewards (“Rewards”) that may change from time to time and, which may be made available for limited times, all as determined by Birchbox in its sole discretion. Birchbox reserves the right to modify these Loyalty Program Terms and Conditions at any time, without notice to you, so it is important to check the Loyalty Program Terms and Conditions periodically. Participation in the Program or redemption of Rewards is considered acceptance of these Loyalty Program Terms and Conditions and any modified terms included therein. Upon notice, Birchbox may, in its sole and absolute discretion, cancel, change, suspend or modify any aspect of the Program or any Program Reward at any time, including the availability of any Program Reward.
This Program will continue until terminated, suspended, modified, or converted to another rewards program by Birchbox (the "Program Period").
To become a Member of the Program, you must be a legal resident of the fifty (50) United States, the District of Columbia, Guam, Puerto Rico, or the US Virgin Islands and be 13 years of age or older. To enroll in the Program, you simply need to have registered for a Birchbox account at https://www.birchbox.com/sign-up. You do not need to have a subscription to earn Points in the Program.
Once you have become a Member, you can begin racking up Birchbox points (“Points”) the following ways:
Shop, shop — every time you purchase a full-size product from our online shop (the “Shop”) or a gift membership, you earn 1 Point for every whole $1 spent per order (excluding tax, shipping charges and fees). If you’re a Birchbox Ace (see below), you earn 1.3 Points for every whole dollar you spend per order!
Refer friends — earn 50 Points for every friend who signs up for Birchbox.
Fill out product feedback surveys — Members earn 10 Points for each completed product feedback survey (look for the feedback icon on every product detail page) for the first 5 products reviewed in connection with your account. For all existing subscribers as of July 11, 2016, you will be able to earn points for the first 5 reviews completed after July 11, 2016. Only products sampled through Birchbox are eligible for feedback Points. For a review to be eligible for Points, in addition to it being among the first 5 reviews, it must be posted between the date your receive your box and the 9th of the month following that box month. For example, if you receive your September box on September 20th, you will have until October 9th to post reviews of the products in the September box and earn points.
Upon notice, Birchbox reserves the right to suspend, terminate, revalue or modify, without liability to Members, all or part of the Points’ value structure and offers and any merchandise or service. Birchbox reserves the right to adjudicate all Points discrepancies in its sole discretion, and the Members agree to abide by any such adjudication. You can check your Birchbox Points balance on your account page.
By choosing to skip your box for 100 Points, you are opting out of receiving your monthly Birchbox. Subscribers who choose this option will be awarded 100 Points following successful subscription billing of $10 (no tax will be charged). 100 Points can be redeemed for $10 in the Shop. The 100 Points added to a customer's account for this skip option will not expire; all other Birchbox Points expire 6 months from the date they were earned. Currently, this option is only available to a select group of subscribers.
Birchbox Ace status is conferred on those registered Birchbox members who spend at least $300 at Birchbox (excluding sales tax). Birchbox Ace status is good for the calendar year in which you qualify and the following calendar year; annual requalification is required. All aspects of the Birchbox Ace program are subject to these Loyalty Program Terms and Conditions and the Site Terms and Conditions. Birchbox may, in its sole discretion, alter, limit, or modify the Birchbox Aces program rules, regulations, benefits, eligibility for membership, or any other feature of the Birchbox Aces program or may terminate the Birchbox Ace program at any time in its sole discretion. Every whole dollar you spend on monthly, yearly and gift subscriptions and full-size products (excluding sales tax) is credited towards your Birchbox Ace eligibility. If you have a monthly rebillable subscription, you will earn $10 toward Ace eligibility each month following successful billing. You can track your progress towards becoming an Ace on your Aces page.
The Points are redeemable towards purchases of full-size products on the Site and in the Birchbox Soho retail store in any increment. You can redeem your Points during the checkout process. You may not use Points to purchase subscriptions.
To redeem your Points, simply add items to your shopping cart, and click the “Checkout” button (if you’re not already signed in, the next screen will prompt you to sign in to your account). Continue through the checkout process. When you get to the Payment Details section, you’ll see a box that that says “Use Birchbox Points” When you click it, your Points will be used and the dollar value will be deducted from your order total. Done! Points are available for redemption for the purchase of products only while supplies last. Product quantities may be limited. If you choose to apply Points to your purchase, you will not able to select the amount of your Points that are applied to the order. If you have more Points than are necessary to complete a purchase, the appropriate number of Points will be applied and deducted from your account to complete the purchase; points not needed to complete the purchase will remain in your account. If you have Points in your account, but not enough to complete the purchase, all Points in your account will be applied to the purchase. You will be asked to select another form of payment to cover the remaining balance. For example, if a Member has a $100 order in her cart, and has 500 Points (equal to $50), she may apply her Points to the purchase and pay the remainder with her credit card. She may NOT use 300 Points (equal to $30) towards the purchase and pay the balance with her credit card.
Any items received as a result of Points redemption may only be exchanged for a refund of the applicable Points redeemed for such item (not cash or credit). Purchases made with Points will ship in the normal course of business. Points earned via credit card transaction purchases on the Site will be rescinded in the event that such purchase is returned for a refund.
You cannot redeem Points for more than the total amount of your purchase. Points are not redeemable for cash.

Except for Points earned via the “Skip Your Box For Points” beta program, Points will expire 6 months from the date they were first earned. If Member does not redeem Points within this time frame, Member forfeits all such Points. Any points earned before July 11, 2016 will continue to have a 1-year expiration from the date first earned. Points earned via the “Skip Your Box For Points” beta program do not expire. Your Account page lists your Points balance history, which displays the dates your points were earned.
Rewards may be taxable, depending on the value of the item and the federal, state, and local tax laws applicable to Member. Members are solely responsible for reporting such items on their tax returns and paying any associated tax liability. Members may not assign or transfer any Rewards. Birchbox makes no warranty in any respect as to any Rewards, merchandise or service available within the Program.
Birchbox may, in its sole and absolute discretion, cancel, change, suspend, or modify any aspect of the Program and/or any Reward at any time, including the availability of any Reward. Birchbox may, in its sole and absolute discretion, terminate or suspend any Member’s participation in the Program for breach of these Loyalty Program Terms and Conditions, or for taking any actions that are inconsistent with the intent of these Loyalty Program Terms and Conditions. Birchbox reserves the right at its sole discretion to prohibit any Member from participating in any aspect of the Program if Birchbox deems or suspects that such Member has engaged in or has attempted to engage in any of the following: (a) acting in violation of these Loyalty Program Terms and Conditions; or (b) damaging, tampering with or corrupting the operation of the Program or Site; or (c) acting with intent to annoy, harass or abuse any other person; or (d) any inappropriate, uncooperative, disruptive, fraudulent, potentially fraudulent, or unusual behavior or activity; or (e) activity deemed in the sole discretion of Birchbox to be generally inconsistent with the intended operation of the Program. Any decision Birchbox makes relating to termination or suspension of any Member’s participation in the Program shall be final and binding in all respects. Birchbox shall be the sole determiner in cases of suspected abuse, fraud, or breach of these Loyalty Program Terms and Conditions or intent of these Loyalty Program Terms and Conditions.
Except for willful misconduct or gross negligence on the part of Birchbox, by participating in the Program, Members release Birchbox, its parent company, subsidiaries, affiliates, suppliers, advertising and promotions agencies and their respective directors, officers, employees, and agents (collectively, “Released Parties”) from any and all liability for any loss, harm, damages, cost or expense, including, without limitation, property damages, personal injury and/or death, arising out of or in any way connected to the Program or the use of any Rewards.
Members agree to indemnify, defend and hold Birchbox and its representatives and agents harmless from and against any and all third party claims, demands, liabilities, costs or expenses, including attorney’s fees and costs, arising from, or related to any breach by Member of any of these Loyalty Program Terms and Conditions or any violation by Member of applicable law.
The laws of the State of New York shall govern these Loyalty Program Terms and Conditions. Member hereby expressly consents to exclusive jurisdiction and venue in the courts located in New York for all matters arising in connection with these Loyalty Program Terms and Conditions or Member’s participation in the Program.
